Welcome to KodaPost. By accessing or using our service, you agree to be bound by these Terms of Use. Please read them carefully before using the service.

1. Service Description

KodaPost is a Koda-powered carousel creation tool that transforms your photos into social media carousels with vintage camera styles, film filters, and Koda-generated text overlays. The service includes image processing, text generation, and optional direct publishing to social media platforms.

2. User Responsibilities

  • You represent that you own or have the necessary rights and permissions to use any images you upload to KodaPost.
  • You are solely responsible for the content you create, upload, and publish through the service.
  • You agree not to upload content that infringes on any third party’s intellectual property rights, privacy rights, or other legal rights.
  • You agree to comply with all applicable laws and regulations when using the service.

3. Acceptable Use

You agree not to use KodaPost to:

  • Upload, process, or distribute illegal, harmful, or offensive content.
  • Infringe on copyrights, trademarks, or other intellectual property rights.
  • Create content that promotes violence, harassment, or discrimination.
  • Attempt to reverse-engineer, decompile, or disassemble the service.
  • Interfere with or disrupt the service or its infrastructure.
  • Use automated means to access the service beyond normal usage patterns.

4. Intellectual Property

Your Content

You retain full ownership of all images you upload and all carousels you create using KodaPost. We do not claim any ownership rights over your content. By using the service, you grant us a limited, temporary license to process your images solely for the purpose of generating your carousel.

Our Service

KodaPost, including its design, interface, code, and Koda engine, is protected by intellectual property laws. You may not copy, modify, or distribute any part of the service without our written permission.

5. Koda-Generated Content

Text overlays, captions, and image enhancements generated by Koda are created for your use. You own the output and may use it for any lawful purpose. However, Koda-generated content may not always be accurate or appropriate. You are responsible for reviewing and approving all generated content before publishing.

6. Social Media Publishing

When you connect social media accounts and publish carousels, you are subject to the respective platform’s terms of service. KodaPost is not responsible for content moderation actions taken by third-party platforms on your published content.

7. Service Availability

KodaPost is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law, KodaPost and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities, arising from your use of the service.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid for the service in the twelve months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless KodaPost, its operators, and affiliates from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms.

10. Modifications to Terms

We may update these Terms from time to time. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms. We will notify users of material changes by updating the “Effective Date” and, where appropriate, providing additional notice.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KodaPost operates, without regard to conflict of law principles.
